This Privacy Policy explains how ProNvest, Inc. dba Future Capital (“Future Capital”, “we”, “us”, or “our”) collects, uses, and discloses information about you through its website, located at https://futurecapital.com (the “Website”) and any other online products or services (“Services”), or when you otherwise interact with us.

We are committed to the responsible management of consumer information and abide by all rules, both ethical and legal, with respect to the use of consumer information.

Due to the nature of our business, the Services and Website are not directed to minors and minors are not eligible to use our Services. How We Collect Personal Information ‍

We collect information from users and clients who access our Website or Services. The types of information collected from users versus clients will differ. Further, the types of information collected may vary by product or service For example, a Website user may provide certain limited Personal Information in order to evaluate our Services or access any free educational tools, whereas a client will provide more comprehensive Personal Information necessary to enable us to provide the Services. To access certain Services, you are required to create an account and provide your name, address, email address, password, birthday, social security number, as well as information about your retirement accounts and transactions, which may include without limitation account balances, holdings, and inquiries. We collect and store information contained in your communications with us via email or other means. You can choose not to provide us with certain information, but this may limit the features of the Website or Services that you are able to use. 

Authorized Representatives ‍

We may receive Personal Information about you from your authorized representatives such as your accountant, financial advisor, broker, or attorney. Any such information is considered Personal Information and is subject to the terms of this Privacy Policy. 

Third-Party Accounts ‍

We may require you to provide account credentials for your third-party accounts, including your 401(k)-provider account or any other accounts necessary for us to perform the Services. We will use such third-party account credentials solely to provide the Services requested by you. The Website allows you to connect with third party accounts through the Services. To provide us authorization to access your third-party account information, you must log in to the third-party account directly through the Services. To revoke our access to any third-party account, you must contact the third-party account provider. 

Third Party Payment Processors ‍

In the absence of an integrated payment process, we may use a third-party payment processor such as Stripe to collect payment and billing information in order to process transactions. Data security, privacy, and handling of payments will be governed by the privacy policy and terms of use of the third-party payment processor. 

How We Use Personal Information ‍

We do not rent or sell your Personal Information to anyone. Our processing of your Personal Information is based on your consent, the necessity to fulfill our contractual obligations with you, and our legitimate business interests. We may store and use your Personal Information for a variety of business purposes, such as to:

Rights Regarding Your Personal Information ‍

You have certain choices about how your Personal Information is used and disclosed. You can review and change some of your Personal Information by accessing your account via the Website. You may also to decline to provide us with Personal Information but declining to provide Personal Information may disqualify you from using the certain portions of the Website or Services. You authorize us to use and disclose any new or modified information that you provide in accordance with this Privacy Policy.‍‍

If you are a resident of certain states, you may have additional rights such as the right to rectify incorrect data, the right to restrict processing, and the right to data portability. You may request that we delete your Personal Information; however, clients and users cannot opt out of providing Personal Information and continue to use the Website or Services. Certain Personal Information is necessary for us to provide the Website or Services and your deletion of such necessary information will interfere with or prohibit your use the Website or Services. Clients and users must close their account in order to opt out of further providing us with Personal Information. In some instances, we may be required (by law or otherwise) to retain this Personal Information and will comply with your deletion request only after we have fulfilled such requirements. Any deleted Personal Information is removed from our active database but may remain in our archives. ‍

If, at any time, you do not wish to accept cookies from our Website or Services for any of the purposes described in this Privacy Policy, then you can change your browser’s settings to disallow cookies, or to prompt you before accepting any cookies from websites you visit. If you do not accept cookies, you may not be able to use any or all portions of the Website or Services.

COMMUNICATIONS

Future Capital Communications

We will communicate with you primarily via email. You can opt out of receiving marketing emails by clicking “unsubscribe” at the bottom of any email or contacting us at info@futurecapital.com. Please note that you cannot opt out of administrative communications such as regulatory, billing notifications, service notifications, or updates to our Terms of Use or Privacy Policy. You may elect to receive SMS communications from us. To opt out of SMS communications, reply STOP to any SMS you receive or contact us at info@futurecapital.com. We process requests to be placed on do-not-mail, do-not-phone and do-not-contact lists as required by applicable law.

Third-Party Communications ‍

Future Capital may offer you the option to receive communications from third parties about products or services that may interest you. Future Capital will never share your information with these third parties without your prior consent. You can withdraw your consent to receive third-party communications at any time by modifying the settings in your account dashboard or, if such dashboard function is unavailable, by contacting us at support@futurecapital.com. 

ANONYMOUS INFORMATION ‍

“Anonymous Information” as used in this Privacy Policy means information that is not associated with or linked to your Personal Information. Anonymous Information does not enable identification of or contact with individual persons.

These third-party services may use Cookies to help track user behavior. Any use of these Cookies by third parties is not covered by our Privacy Policy. Some features that may be utilized include but are not limited to remarketing, audiences, demographic, or location information. We do not have access or control over these Cookies. For example, Google Analytics plants a persistent Cookie on your web browser to identify you as a unique user the next time you visit the Website. This Cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Website is restricted by the Google Analytics Terms of Service and the Google Privacy Policy. We may also obtain Information from Partners, Business Associates and Unrelated Entities and combine that with Personal Information we collect about you.

The Website or Services may contain content or links to other websites. Any information you send to entities that are linked to our Website or Services is out of our control and not covered by this Privacy Policy. We have no control over, do not review, and are not responsible for any privacy policies of or content displayed on such other websites. If you click such a link, you will leave Future Capital and another entity may collect Personal Information or Anonymous Information from you. The Website or Services may also contain links to other websites controlled by us, but which operate under different privacy policies. Please review the privacy policy of any new website you visit. 

STATE PRIVACY NOTICE AND NOTICE TO CALIFORNIA RESIDENTS  ‍

Certain states have enacted privacy laws giving their residents certain rights and entitling them to additional disclosures regarding data collection practices.   If you are a resident of a state that has enacted such a privacy law including but not limited to the California Consumer Privacy Act of 2018 (“CCPA”) and California Privacy Rights Act (CPRA) (collectively, “State Privacy Laws”), this section applies to you. As used in this Section, “Data Subject Request” refers to rights under State Privacy Laws to request access to and copies of your Personal Information, as well as to seek corrections, deletions, or restrictions on the processing of such data. In order to respond to or fulfill any request, we must first verify your identity. If we are unable to verify your identity, we cannot provide any personal information.  ‍

You may request information regarding our data practices and the third parties to whom we have disclosed their Personal Information in the prior calendar year, including the type of information disclosed, the purpose for disclosure, and the categories and specific pieces of Personal Information we have collected about you.  We will provide the requested information to you after confirming your Data Subject Request.

Data Correction

You have the right to request that we correct inaccuracies in your Personal Information. If you have an online account, you can correct certain information through your dashboard.

Data Deletion ‍

You may request that Future Capital delete your Personal Information, unless an exception applies. Future Capital is not required to delete your Personal Information under certain circumstances, including circumstances where we are legally obligated to retain the information or if the information is needed to defend a legal claim. Future Capital will process all requests in accordance with its legal obligations under the applicable State Privacy Law. Please note that if you request deletion of your Personal Information, you may no longer have access to any or all portions of the Website or Services.   

Opt-Out of Sharing or Sale

Certain State Privacy Laws require us to disclose information related to targeted advertising. We may share certain Personal Information with third-party marketing providers to show you relevant content and advertisements. Some State Privacy Laws may consider such activity to be a sale of “Personal Information” however Future Capital does not receive any kind of monetary payment in exchange for Personal Information that we collect from you.

Submit a Request ‍

You may submit your request for an electronic copy of Personal Information (by you or your verified authorized representative) or for deletion of your data to us via email at: info@futurecapital.com.  Future Capital will acknowledge a Data Subject Request within 10 days and will attempt to respond within 45 days. We will inform you if more time is required and may require up to 90 days in total. You will not be charged any fee for our processing of your Data Subject Request.

DO NOT TRACK ‍

We do not currently respond to “do not track” signals or other mechanisms that might enable consumers to opt out of tracking on the Services. 

AMENDMENTS TO THIS PRIVACY POLICY ‍

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy on this page and we will change the “Last Updated” date located at the top of this page. You should consult this Privacy Policy regularly for any changes.
